Laberty Founder License

These are the terms of the Laberty Founder license. They are written to be read. By buying the license you agree to them.

"We" and "us" means the seller of Laberty at laberty.app. "You" means the person or organization that bought the license, as named by the email address used for the purchase. "The Software" means the Laberty source code, documentation and other files we deliver to you under this license, including every update you receive during your update period.

1. What you get

In exchange for the one-time fee, we grant you a perpetual, worldwide, non-exclusive, non-transferable license to:

  • use the Software,
  • copy it, as many times as you need for the uses below,
  • modify it and make works based on it, and
  • run it yourself ("self-host"), for example on your own Cloudflare account with your own API keys, email sender and payment account,

for your own household or your own organization's internal purposes. Internal purposes include letting your organization's employees, contractors and family members use your copy.

"Perpetual" means this license does not expire. It lasts until it ends under section 9.

2. What you may not do

You may not:

  • sell, resell, sublicense, rent, lend, give away or otherwise distribute the Software or any modified version of it, in source or compiled form, to anyone outside your household or organization;
  • publish the Software or a modified version, for example in a public repository;
  • offer the Software, or anything built from it, as a hosted service to other people or organizations, paid or free, including a service that competes with laberty.app;
  • share your repository access or your license key with anyone outside your household or organization;
  • remove or hide the copyright and license notices in the Software.

Running a copy for your own organization's customers to use as part of that organization's own business is also a hosted service for other people, and is not allowed without a separate written agreement with us.

3. Delivery

We deliver the Software through read access to a private GitHub repository. You tell us a GitHub username, and we invite it. You can set or change that username in your license portal at laberty.app/license. When the username changes, the old one loses access.

Your license key is proof of purchase. It never expires.

4. Updates: 12 months

You receive updates we publish to the repository for 12 months from the date of purchase (your "update period"). We decide what goes into an update and when; we do not promise any particular feature, fix or schedule.

When your update period ends, your access to the repository ends. You keep every version you received, and this license continues to cover them. We email you about 14 days before it ends.

5. No support

The license includes no support. We do not answer questions about installing, hosting, configuring, upgrading, debugging or changing your copy, by email, the contact form or any other channel. What you get is the Software and its documentation.

6. Your own services and keys

Running the Software needs accounts and keys of your own, for example Cloudflare, an email provider, AI providers and, if you use it, Stripe. Those services are yours: you agree to their terms, and you pay for them. We have no access to your copy, your data or your keys.

7. Ownership

We, and our licensors, keep all rights, title and interest in the Software that are not expressly granted to you here. You own your modifications, but you may only use them together with the Software under these terms. If you send us suggestions, we may use them without obligation to you.

Parts of the Software may be third-party open-source components under their own licenses. Those licenses apply to those components, and nothing here limits your rights under them.

8. Refunds

You can ask for a full refund within 14 days of purchase, as long as you have not accepted the GitHub invitation (that is, you have not yet had access to the code). Ask through the contact form at laberty.app/help/contact with the email address you bought with. A refund ends this license and removes your access.

After you have accepted the invitation, or after 14 days, purchases are final, except where the law requires otherwise.

9. Ending the license

This license ends automatically if you materially break these terms and do not fix the breach within 30 days after we tell you about it (or at once, if the breach cannot be fixed, such as publishing the Software). It also ends if you receive a refund.

When it ends, you must stop using the Software and delete your copies. Sections 2, 7, 10, 11, 12 and 13 continue to apply after it ends.

We cannot end this license for any other reason. In particular, it does not end because your update period ends, because we stop selling Laberty, or because laberty.app shuts down.

10. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not promise that the Software is free of errors or security vulnerabilities, that it will work with any printer, service or key, or that it will keep working with third-party services that change.

11. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS LICENSE, HOWEVER CAUSED, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SOFTWARE OR THIS LICENSE IS LIMITED TO THE AMOUNT YOU PAID FOR THE LICENSE.

Some places do not allow some of these exclusions or limits. Where that is the case, they apply only as far as the law allows.

12. Transfers

You may not transfer this license, except together with the whole of the business or organization that uses the Software, and only if you tell us first and the new owner agrees to these terms. We may transfer our side of it to a successor.

13. General

These terms are the whole agreement about the Founder license and replace anything said before about it. If a court finds part of them unenforceable, the rest still applies. Not enforcing a term is not a waiver of it. These terms are governed by the laws of the place where the seller has its principal place of business, without regard to conflict-of-law rules, unless the law where you live requires otherwise.

We may publish new versions of these terms for future purchases. The version you agreed to, shown at the top and stored with your license, keeps applying to your license.
